Terms of Service

Thank you for using OwnOS.

These terms govern your use of the OwnOS platform and services.

By using OwnOS, you agree to these terms. If you don't agree to these terms, please don't use OwnOS. Violating these terms may result in your account being deactivated.

Beta version

OwnOS is currently beta software. Some features may be incomplete, experimental, unavailable, or changed before general release. Bugs, interruptions, sync issues, export issues, or data loss may occur.

Please do not use OwnOS as the only place you store critical information. Keep independent backups of anything important.

We will make reasonable efforts to protect your content and data, maintain backups, and restore service if something goes wrong, but OwnOS is provided during beta on an "as is" and "as available" basis. To the fullest extent allowed by law, we are not responsible for loss of data, loss of access, lost profits, business interruption, or other damages resulting from beta bugs, outages, or service changes.

The basics

  • "OwnOS" refers to the OwnOS platform and services.
  • "You" refers to the individual user of OwnOS.
  • "Content" means data, text, files, notes, lists, tasks, bookmarks, contacts, planner entries, or other material you create, upload, store, or share through OwnOS.
  • "Connection" means another OwnOS user you have authorized to exchange content with.

OwnOS is a privacy-first personal productivity platform.

You own your data. We provide the service. We don't own what you create. You grant OwnOS a limited license to host, store, process, display, transmit, and back up your content solely as needed to provide, secure, maintain, and improve the service, and to follow your instructions, including when you share content with a Connection. This license ends when your content is deleted, except where retention is required for backups, legal compliance, security, or dispute resolution.

We don't sell your data.

These terms, along with our Privacy Policy, govern your use of OwnOS.

Your account

  • You must be at least 18 years old to use OwnOS.
  • You are responsible for all activity under your account.
  • You are responsible for your account security. Use a strong password.

Your data

What you own

The content you create in OwnOS belongs to you.

Sharing

You can share content with your Connections in OwnOS. When you share content, the recipient receives a copy. Once sent, that content is under the recipient's control — you cannot recall, edit, or delete it from their view. Be thoughtful about what you share.

You are responsible for what you choose to share. OwnOS is not responsible for how recipients use, store, or redistribute content you send them.

Do not share content you don't have the right to share.

What you can do

  • Export your data at any time in standard formats (JSON, PDF)
  • Request deletion of your account and data at any time
  • Request a copy of all data we have about you

What we do with your data

We do not access or review your content except as needed to:

  • Provide the service
  • Respond to legal requirements
  • Respond to customer support requests
  • Investigate reports of violations of these terms

We use reasonable administrative, technical, and organizational safeguards designed to protect your data, including encryption in transit and at rest, restricted production access, and periodic security reviews.

We maintain automated backups of your data, encrypted and stored separately from our primary infrastructure. Backups are deleted within 90 days of account deletion.

We do not analyze your content for advertising, profiling, resale, or AI training. Our business model is simple: OwnOS monthly subscriptions.

Third-party providers

We use reputable third-party service providers to operate OwnOS and deliver core functionality (such as hosting, authentication, and data storage). We choose providers with strong security practices and reliable service-level agreements.

Subprocessors

We use a small set of trusted providers:

  • Supabase — Database, authentication, storage. Also handles authentication-related transactional emails. Privacy policy
  • Netlify — Web hosting and CDN. Privacy policy
  • Google — Sign in with Google (OAuth 2.0) and Google Workspace for transactional email. Privacy policy
  • Sentry — Error monitoring. When something breaks in the app, Sentry receives a report with the error message, the line of code that failed, and basic technical context so we can fix the bug. Used only to diagnose and fix issues. Privacy policy

We do not use advertising networks, data brokers, or third-party trackers. We do not use your content to train AI models, and we do not sell or share your content with AI providers for training.

We are not responsible for outages, failures, or policy changes of third-party services not operated by OwnOS.

We may update our subprocessors as needed and will maintain a current list in these Terms or our Privacy Policy.

Acceptable use

Use OwnOS for lawful purposes. Don't use it to:

  • Engage in illegal activity, facilitate serious harm, or promote goods or services that are unlawful or intended to harm people or animals
  • Create, upload, or distribute content that exploits or abuses children, including child sexual abuse materials
  • Harass, abuse, or harm others
  • Impersonate others or misrepresent your identity
  • Attempt to breach or test our security without permission
  • Attempt to gain unauthorized access to OwnOS systems or other users' accounts
  • Overload our systems with automated requests
  • Distribute malware or spam
  • Interfere with or disrupt the service for other users
  • Violate the intellectual property rights of others
  • Violate the privacy, publicity, confidentiality, or data protection rights of others

We may suspend or terminate accounts that violate these terms.

We may review content if we receive reports of violations and take action, including restricting access to content, removing content, or disabling your account. If we become aware of illegal activity, we may report it to the appropriate authorities.

Service availability

  • We may perform maintenance that temporarily affects access.
  • We'll notify you of planned maintenance when possible.
  • We aim for high availability and take uptime seriously, but we do not guarantee uninterrupted or error-free service.

Payments and refunds

Free tier

Limited features, no payment required. We may change free tier limits with 90 days' notice.

Pro tier (expected soon)

Billed monthly. You can cancel anytime. Access continues until the end of your billing period.

Refunds are handled case by case. If you are unhappy with a paid subscription, email us and we will review the issue in good faith.

Price changes

We may change prices with 90 days' notice. Price changes don't affect your current billing period.

Account termination

By you

You can request account deletion at any time. Active account data is deleted within 30 days. Encrypted backups containing your data may persist for up to 90 days before being overwritten or deleted.

By us

We may terminate accounts that violate these terms. We may terminate accounts inactive for more than 12 months (free tier only).

We will give at least 30 days' notice before termination so you can export your data, except in cases of serious abuse or illegal activity where immediate action is required.

Changes to the service

We continuously improve OwnOS. Features may change. We won't remove core functionality without notice. If we make changes you don't like, you can export your data and discontinue using OwnOS.

Changes to these terms

We may update these terms occasionally. We'll notify you of significant changes via email or in-app notice at least 30 days before they take effect. Continued use after changes means you accept the new terms.

Liability

Indemnification

You agree to defend, indemnify, and hold harmless OwnOS and its owners, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these terms.

Limitation of liability

OwnOS is provided "as is" and "as available." We do our best to keep it secure and available, but:

  • Because OwnOS is beta software, bugs, outages, sync issues, and data loss may occur. Keep your own backups of critical data. To the fullest extent allowed by law, we are not responsible for data loss or loss of access except as stated in these terms.
  • We're not liable for decisions you make based on your content in OwnOS.
  • Our total liability is limited to the greater of (a) the amount you paid us in the past 12 months, or (b) $50 USD.

Nothing in these terms limits our liability for fraud, gross negligence, willful misconduct, or anything else that cannot be limited by law.

Disputes

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.

If a dispute arises, please email us at help@ownos.app. If we can't resolve it informally within 90 days of your initial email, either party may bring the dispute in the state or federal courts located in Bexar County, Texas. You and OwnOS consent to the jurisdiction and venue of those courts, except for claims that may be brought in small claims court.

Class action waiver. You agree to resolve disputes individually and waive the right to participate in class actions.

If you are located in a jurisdiction where class action waivers are unenforceable for consumer contracts, that provision does not apply to you.

General

  • Severability. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
  • Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and OwnOS regarding the service.
  • Assignment. You may not assign your rights under these terms without our consent. We may assign ours in connection with a merger, acquisition, or sale of assets, with notice to you.
  • Force majeure. We are not liable for service disruptions caused by events beyond our reasonable control, including natural disasters, war, pandemics, or infrastructure failures.
  • Waiver. Our failure to enforce a provision of these terms is not a waiver of our right to enforce it later.
